9Searches TOTAL LIABILITY ARISING OUT OF ANY TYPE OF LEGAL CLAIM (WHETHER IN CONTRACT, COURT OR OTHERWISE), SHALL BE LIMITED TO ANY AMOUNTS YOU MAY HAVE PAID TO 9Searches AND, IN THE ABSENCE OF ANY SUCH PAYMENT, 9Searches SHALL HAVE NO LIABILITY.

Without limiting the foregoing, under no circumstances shall 9Searches, its employees or any members of 9Searches Editing Team be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

Requests for Removal of Links

9Searches SERVICES consist of information that has been identified, reviewed, indexed and compiled by 9Searches editors. 9Searches occasionally receives requests from people to remove links from its indices. Although 9Searches reserves the right to address such requests individually, the general principles for such actions are:

9Searches would consider on a case-by-case basis requests to remove the link to a site from its indices. For each web site reflected in 9Searches SERVICES, 9Searches may remove links if either (i) a site owner restricts access to his or her web site or (ii) a site is taken down from the web, or (iii) a site is placed in an inappropriate category or (iv) a site's content has changed significantly then, upon receipt of a request by the site owner or a third party in any instance.

9Searches reserves the right, at our sole discretion, to remove links or to take action on your request.

Miscellaneous Provisions

These Terms of Service are governed by and construed in accordance with the laws of the State of Kentucky, without giving effect to its conflict of laws are provisions to your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of this Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.

These Terms of Service constitutes the entire agreement between the parties and 9Searches with respect to the subject matter hereof and any future changes made by 9Searches to these Terms of Service supersedes and replaces all prior or contemporaneous understandings of our terms of service, written or oral, regarding such subject matter.
